What Happens to a Debt When the Debtor Dies?

By Mary Baker, Esq., General Counsel / Debt Counsel for Seniors and the Disabled

What happens to a debt after the owner dies? Unfortunately, it does not just go away. Here are some facts to keep in mind if you are a debtor who is trying to do some estate planning. You might want to share this information with family members as well.

Tax Life BoatIRS Problems Can Result from Debt Cancellation

By Tom Evans, President / TaxLifeboat www.taxlifeboat.com

The good news is your credit card debt was cancelled. The bad news is that the amount discharged is classified as current income and the IRS says you owe taxes on it. Fortunately for many seniors, that does not have to be the case.

How This Issue Can Apply to You
Personal loan and mortgage defaults are common occurrences in these challenging economic times. US tax laws hold that, with few exceptions, forgiveness of debt is taxable income to debtor. The primary exceptions are 1) the debt is discharged in bankruptcy and 2) a foreclosed home is sold for less than the amount of the mortgage....

FraudWatchTis the Season for Financial Crimes Against Seniors

Courtesy of the Better Business Bureau

According to the National Crime Prevention Council, seniors fall prey to fraud for a variety of reasons. Furthermore, many older people are complacent or forgetful of details and may be embarrassed to admit they’ve been “had” by a scam artist...
